Mediation Services

There are now time saving, money saving ways to resolve conflicts which are exciting alternatives to going to court.

What is Mediation?

Mediation is one way to resolve conflicts without proceeding to court, or to trial. Generally, in mediation, the parties (and their attorneys, if they are represented) attend a meeting where the mediator facilitates the parties in discussing their differences and reaching an agreement on how to resolve the problem. Mediation is not binding on the parties and a case can still proceed to the courts or to trial if the mediation fails.

Mediation is different from arbitration. Arbitration is more like a trial in that the decision of the arbitrator is final and is binding on the parties unless they ask the court to intervene further.

A mediator is more likely to act as a facilitator, an arbitrator acts more like a judge. Mediation and arbitration together are often referred to as Alternate Dispute Resolution or ADR.

In 1997 the United States Bankruptcy Court for the Central District of California established a pilot mediation program. The program was set up in order to try to settle litigations before the cases went to trial. The objective was to save the litigants money and to lighten the load on the bankruptcy judges.

The program has been very successful. Sixty-five percent of all cases assigned to mediation have been settled.

Experience and Awards

Mr. Moses was a member of the first group of Orange Coutny attorneys accepted into the mediation program. In 1999 he received a special award from the Federal Judges for settling the most cases in the Santa Ana Division. In 2001 he received a second award for settling the most cases in the entire Central District of California. That district is comprised of the counties of Los Angeles, Orange, Ventura, Santa Barbara and Riverside.

In cases already in litigation, mediations can be set by the judge or by agreement of the parties. Normally the parties can ask the judge for a specific mediator.
